Terms of Service & Disclaimer of Liability

1. Acceptance of Terms & Legal Capacity

By visiting, registering an account on, or utilizing the services provided by ADZ FeRaL Psychosocial Services (the "Platform"), you irrevocably agree to be bound by these Terms of Service. If you do not accept these terms in their entirety, you are strictly prohibited from accessing the website.

You affirm that you are at least eighteen (18) years of age or possess legal parental / guardian consent pursuant to Section 7 of this agreement, and are fully competent to enter into this legally binding covenant.

2. ABSOLUTE LIMITATION OF SUPERADMIN & PLATFORM OWNER LIABILITY

To the maximum extent permitted by applicable law in the Republic of the Philippines:

• No Liability for Specialist Practice: All mental health assessments, counseling sessions, psychometric tests, therapy interventions, and written clinical evaluations are provided solely by independent, licensed psychologists, psychometricians, or guidance counselors under their individual professional licenses issued by the Professional Regulation Commission (PRC). The SuperAdmin and clinic platform operators bear ZERO LIABILITY for any specialist's diagnoses, opinions, treatment advice, professional errors, omissions, or therapeutic outcomes.
• No Liability for User Outcomes: In no event shall the SuperAdmin, clinic owners, directors, software developers, or contractors be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to emotional distress, mental anguish, relationship conflicts, employment decisions, loss of data, or financial losses arising out of or in connection with the use of this portal.
• Waiver of Claims: You expressly release, waive, and forever discharge the SuperAdmin and technical platform operators from any claims, suits, or administrative demands arising from specialist-client interactions.

3. Comprehensive Indemnification & "Hold Harmless" Covenant

You agree to fully defend, indemnify, and hold harmless ADZ FeRaL, its SuperAdmin, clinic officers, employees, independent software maintainers, and representatives from and against any and all claims, liabilities, damages, losses, expenses, or attorney's fees arising from or related to:

• Your violation or breach of any provision of these Terms of Service.
• Your submission of false, inaccurate, fraudulent, or forged demographic or medical information.
• Your upload of unauthorized files, third-party intellectual property, or defamatory materials.
• Any disputes, conflicts, or legal actions between you and any licensed specialist on the platform.
• Your failure to adhere to clinical instructions or seek emergency medical care during acute psychological distress.

4. User-Submitted Files, OMR Sheets & Document Handling

When users or clinic staff upload files (including scanned OMR bubble sheets, handwriting samples, clinical intake attachments, or profile photos) to the platform:

• Ownership & Authorization Warranty: You represent and warrant that you own or have obtained lawful authorization and consent from all relevant individuals to upload and process said files.
• No Liability for Data Corruption or Hardware Failure: While ADZ FeRaL implements secure storage and backup architectures, the platform and SuperAdmin bear no liability for accidental file corruption, upload interruptions, packet loss, or server hardware failures. Users are advised to maintain independent physical records of clinical sheets where applicable.
• Automated Assessment Disclaimer: Automated OMR optical recognition scores and algorithmic preliminary interpretations are strictly auxiliary screening aids. They do NOT constitute an automated final diagnosis and must be clinically verified and countersigned by a PRC-licensed psychologist.

5. "As-Is" Service Availability & Force Majeure

The platform, including all scheduling, messaging, and notification features, is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

The SuperAdmin and clinic shall not be held liable or in default for any delays, failures, or interruptions resulting from circumstances beyond reasonable control, including but not limited to telecommunications carrier outages (Globe, Smart, DITO, PLDT), SMS dispatch latency, power grid failures, hosting provider maintenance, cyber-attacks, natural disasters, or government declarations.

6. Account Security & Two-Factor Authentication Compliance

Users are solely responsible for maintaining the confidentiality of their account password and their TOTP Two-Factor Authenticator secret key.

• You must immediately notify ADZ FeRaL of any suspected unauthorized access or compromise of your login credentials.
• Any appointment bookings, report views, or messages initiated under your authenticated credentials shall be presumed conclusively to have been authorized by you.

7. Minors and Legal Guardian Authorization

In compliance with Philippine family law and child protection statutes, clients below eighteen (18) years of age may only register or undergo psychological consultations with the verified, documented consent of their parent or legally appointed court guardian. The parent or guardian assumes full legal responsibility for all platform activities and fee commitments.
