1. Technical Infrastructure Role & Absence of Fiduciary Medical Duty
Notice to All Visitors, Clients, and Practitioners:
ADZ FeRaL is a cloud-based Practice Management System (PMS), Optical Mark Recognition (OMR) grading assistant, and appointment portal. ADZ FeRaL Management, technical systems architects, hosting providers, and administrative operators provide software infrastructure ONLY.
ADZ FeRaL Management is not a hospital, does not provide medical diagnoses, does not administer prescription medication, and does not establish a doctor-patient or psychologist-client fiduciary relationship with any user accessing this domain.
2. Total Exclusion of Medical Malpractice & Clinical Liability
All psychological assessments, consultations, counseling sessions, therapy plans, diagnostic reports, and clinical notes available or referenced on this platform are conducted solely and independently by individual practitioners licensed by the Professional Regulation Commission (PRC) pursuant to the Philippine Psychology Act of 2009 (Republic Act No. 10029).
- Individual Specialist Accountability: Each licensed psychologist or psychometrician functions as an independent professional. ADZ FeRaL Management exercises no clinical control, direction, or medical oversight over the professional judgment of any specialist.
- No Vicarious or Derivative Liability: To the fullest extent permitted by Philippine law, ADZ FeRaL Management and platform owners shall have ZERO VICARIOUS, DERIVATIVE, OR JOINT LIABILITY for any specialist's diagnoses, opinions, treatment regimens, alleged negligence, delayed sessions, professional errors, or therapeutic outcomes.
- Direct Specialist Recourse: In the event of any grievance or professional dispute, the user's sole recourse lies directly with the treating specialist or through the regulatory jurisdiction of the Professional Regulatory Board of Psychology and PRC.
3. High-Volume File Uploads, Document Flooding & Data Disclaimer
Users, clinic personnel, and practitioners frequently upload high volumes of documents, test papers, OMR scan images, handwriting samples, and clinical attachments to the platform.
You represent and warrant that you hold all necessary legal rights, patient consents, and statutory authority under RA 10173 for any and all files or images you transmit or upload. ADZ FeRaL Management bears no liability for unauthorized uploads by third parties.
While the platform employs secure cloud storage and directory sharding to remain smooth under heavy file traffic, ADZ FeRaL Management assumes no liability for corrupted files, transmission interruptions, hardware failures, or force majeure data losses. Users must maintain their own offline backup records.
ADZ FeRaL Management makes no representation that the platform is an archival vault. The platform reserves the right to prune temporary scan artifacts, throttle uncompressed media, or archive historical records in accordance with institutional data retention schedules.
4. Algorithmic OMR Scoring & Automated Screening Disclaimer
Optical Mark Recognition (OMR) grading, bubble-grid coordinates, computerized subtest scoring, and automated FeRaL AI chatbot responses are strictly auxiliary mathematical and informational screening tools.
- Automated score calculations, percentiles, stanines, or diagnostic brackets generated by the computer do not constitute a definitive psychiatric or psychological diagnosis.
- All automated test results require human clinical interpretation, validation, and countersigning by a PRC-licensed psychologist before any clinical or legal reliance may be placed upon them.
- ADZ FeRaL Management is completely held harmless from any reliance placed upon unverified automated outputs or preliminary score printouts.
5. Third-Party Telecom, SMS Gateways & Network Non-Liability
Notification dispatches, SMS verification tokens (Semaphore), email appointment reminders, and Two-Factor Authentication (2FA) codes depend on third-party mobile telecommunication carriers (Globe, Smart, DITO, PLDT) and cloud gateways beyond ADZ FeRaL Management's control.
ADZ FeRaL Management shall not be held liable for any missed consultations, session reschedules, SMS latency, delivery failures, carrier filtering, power grid interruptions, or ISP routing downtime.
6. Comprehensive Indemnification & "Hold Harmless" Covenant
You agree to fully defend, indemnify, and hold harmless ADZ FeRaL, its Management, clinic directors, developers, system administrators, and agents from and against any and all claims, actions, suits, demands, damages, liabilities, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to:
- Your use or misuse of the platform or any services booked through it.
- Any inaccurate, fraudulent, or forged information provided during registration or consultation intake.
- Any unauthorized, copyrighted, or non-consensual documents or media uploaded to the system.
- Any disputes, malpractice complaints, or fee contentions between you and any licensed practitioner.
- Any failure on your part to seek emergency medical, psychiatric, or crisis intervention services in a timely manner.
7. Statutory Privacy Compliance (RA 10173 & RA 11036)
All data handling is strictly governed by the Philippine Data Privacy Act of 2012 (Republic Act No. 10173), its Implementing Rules and Regulations, National Privacy Commission (NPC) circulars, and the confidentiality provisions of the Philippine Mental Health Act (Republic Act No. 11036).

8. Governing Law & Exclusive Judicial Jurisdiction
